OUR FIRM

Founded in 1995, this firm assists counsel, insurance carriers, self-insured employers, and third party administrators in settling workers’ compensation and liability claims while preserving the claimant’s Medicare eligibility. We communicate closely with the Workers’ Compensation and Liability attorneys as well as the Self Insured or Insurance Carrier to ensure compliance with Medicare’s statutes and regulations. Our courteous and knowledgeable staff are accessible and eager to provide prompt answers to your questions.

When settling claims, parties must consider Medicare’s interests under the Medicare Secondary Payer (MSP) Act. Medicare’s preferred method of compliance is for the settlement to include funding of a Medicare Set-Aside (MSA). This involves setting aside a portion of the settlement funds to cover injury related medical care that would otherwise be covered by Medicare. If the Centers for Medicare & Medicaid Services (CMS) determine the set-aside amount is adequate, Medicare will agree to primary payer status once the MSA funds are exhausted.

To ensure any subrogation interests held by Medicare are satisfied pursuant to the MSP Act and regulations, Medicare recovery claims must also be resolved. Our firm conducts conditional payment research to determine whether CMS intends to pursue recovery and to identify the conditional payment amounts. Our attorneys offer legal services to reach compromise or waiver of those conditional payment amounts, while preserving the claimant’s Medicare benefits.

We offer a wide range of national case management services. Our case managers work directly with the injured worker, physician or medical provider, employer, adjuster and attorney to provide quality services. All of our case managers follow strict guidelines to help the claimant to get MMI and return to work as soon as possible. Our case managers are experienced in handling acute and long-term clients.

Mrs. Watson is responsible for business development and client relationships. With over 15 years in the workers' compensation and liability insurance industries, Leigh Ann brings Manley & Associates clients her vast experience gained from current relationships with an extensive list of national TPAs, insurance companies, and self-insureds.

Mrs. Watson began her career in the Workers’ Compensation claims arena with a regional carrier, progressing rapidly from the operations to the business development side of the industry.

Leigh Ann, a native of Georgia, resides in Dunwoody. Leigh Ann has been actively involved with Kids' Chance, Inc, raising funds for the children of catastrophically injured workers.

Amber Timms

Director of Operations

Background

Ms. Timms directs the activities of the firm and oversees the day-to-day operations. She brings 10 years of operational, sales and educational experience in Medicare Secondary Payer Compliance for Workers' Compensation and Liability cases as well as Nurse Case Management to the firm. She has previously worked with Insurance Carriers, Employers, and Third Party Administrators to bring compliance to their cases. Amber is a native to Georgia, and resides in Flowery Branch with her family.

Carolyn Watson

Background

Carolyn is a seasoned Medical Case Manager with 30 years workers’ compensation, disability management and eldercare experience. She is licensed as a Registered Nurse in her home state of Georgia as well as Alabama and North Carolina. She is also a certified case manager through CCMC and registered with Georgia and Tennessee as a rehabilitation provider. Carolyn worked as a Field Case Manager, Telephonic Case Manager and Branch Manager with major workers’ compensation payers which allows her to have a unique understanding of the needs of injured workers, as well as the carriers. Due to her diverse background in TCM, Utilization Review and Bill Review she has an excellent understanding of medical cost management. Carolyn also has a strong commitment to quality and training. From her experience building and rebuilding case management teams and developing case managers; her motto has become, “Practice what I preached” to assure exceptional service delivery.

David Touchstone

Field Case Manager

Background

David is a case manager who has worked in both the Insurance and Work Comp setting for over 20 years. He received his Bachelor of Science in Nursing from the University of Southern Mississippi and is licensed in the State of Georgia as a Registered Nurse. He is also a certified case manager through CCMC. David's clinical experience includes orthopedics, pain management and sub-acute rehabilitation. He then transitioned from the hospital setting to the insurance and workers' compensation field. David has the unique background of working as both a Claims Adjuster, and as the lead nurse of a Special Investigative Medical Team reviewing potentially high risk and fraudulent claims. David's motto is, "Keep moving forward", to ensure there is always positive progression.

Ann M. McKinness

Background

Ann is a seasoned Medical Case Manager with over 20 years experience, and an extensive nursing background. Ann is based out of Fort Mill, SC and covers a large area in North and South Carolina.
